What personal data we collect and why we collect it

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

How long we retain your data

Trip and Booking Terms and Conditions

Below are our standard terms & conditions, it is important that you read, understand, and accept these conditions. The lead contact who books a trip will be confirming on behalf of all parties travelling that they have read and understood the below. If you have any questions concerning any of these conditions, please feel free to contact us at any time.


Please note: Gillhams Holidays UK Limited acts as a booking agent on behalf of the suppliers listed on its website and as such may receive a commission for any bookings made through this service.

Your Contract With Us

Please take time to read these terms and conditions it is important for both of us that you understand our contractual relationship relating to your holiday. When a booking is made, the ‘lead contact’ on the booking guarantees that he or she has the authority to accept and does accept on behalf of the party the terms of these booking conditions.


A contract will exist as soon as we receive your deposit. It is the responsibility of the ‘lead contact’ to confirm that all the details are correct, including the spelling of all first and surnames of all travelling members. This contract and all matters arising from it are subject to English law and the sole jurisdiction of the English courts.


On receipt of Gillhams Holidays UK Limited invoice, it is important to check that all the details are exactly as you requested. In the event of any discrepancy, please contact us immediately where we will look to resolve any discrepancies. If you want to cancel or change your booking later you may have to pay amendment or cancellation costs (described below), which may be as much as the whole holiday cost.


All destination descriptions are made in good faith and every care is taken to ensure their accuracy. However, because of the detail contained therein and the fact that information has been prepared some time in advance of distribution of the Holidays; advertised facilities, amenities, entertainment, and schedules may, on occasion, be restricted, curtailed, changed, or cancelled. Therefore, changes may be made to the particulars you have seen at any time before the contract with you is made. In these circumstances, we will endeavour to notify you of such changes before confirmation of your booking.

Payment Methods

We accept payment by all major debit and credit cards, or you can transfer money directly into our UK bank account account. Where a discount is offered we may not be able to take payment by credit or debit card.

​All our prices are quoted in GBP sterling unless otherwise stated. Any prices quoted in local currencies are then exchanged back to GBP for invoicing purposed. Please note that rates may differ to those which you may see advertised online.

​The outstanding balance, as indicated on your deposit invoice, will be due 120 days before arrival. If this payment is not received, Gillhams Holidays UK Ltd reserves the right to deem the booking as cancelled, with the normal cancellation conditions applying. If any booking is made within 120 days of the arrival date the full payment is required on booking.

Cancellations

All cancellations must be in writing. The date Gillhams Holidays UK Ltd receives the confirmation of cancellation is deemed as the effective cancellation date and the cancellation charge conditions apply from that date, as detailed below.

​119 days or less from arrival date                    100% of trip cost per invoice

​120 days or more from arrival date                 Retention of non-refundable deposit per invoice

If in the event that a refund is issued, all refunds will be subject to a 10% administration charge and up to 72 hours should be allowed for these to be processed.

Insurance and Travel Documents

It is advised for all trips, that each traveller has adequate medical insurance, covering personal accident, medical expenses, and repatriation. It is advised that each traveller has adequate insurance to cover any cancellations as a result of Coronavirus. It is the lead contacts responsibility to ensure that all guests have adequate insurance to satisfy the entry requirements of the destination country where this is specifically specified by the government of the destination country.

​It is the sole responsibility of each customer to ensure that they have a valid passport and any valid visas and permits required for your trip. You must also have any medical certificates that may be required. Gillhams Holidays UK Ltd provides on the web site an indication of what might be required, although this is only for guide purposes and may not be exhaustive. It is and remains the responsibility of the ‘lead contact’  to check and make sure with the country’s relative embassy that details are correct. Gillhams Holidays UK Ltd does not accept responsibility if your documentation is not valid, resulting in refused travel, entry and any associated cost.

It is the lead contacts responsibility to ensure that all travellers on the booking are fully vaccinated to ensure entry to the destination country. It is also the lead contact’s responsibility to ensure that all visas and entry passes have been obtained prior to travelling. Gillhams Holidays UK Limited, will not be held responsible for trip amendments, and or cancellations where a guest on the booking is unwilling or unable to ensure that the entry criteria of a destination country have been fulfilled, and as such in any instance of this occurrence, we will deem this as your cancellation of the booking, which will then be subject to the cancellation conditions above.

Standards

Standards vary and we do appreciate people have differing requirements. It must be remembered that some of our more exotic, pioneering tours will include trips to remote locations with limited facilities. If you have any doubts as to suitability please do not hesitate to contact us.

Weather

We all know only too well that weather can have a major impact, not only on your holiday stay but also on the actual fishing. Delays/cancellation due to bad weather will be handled most professionally.

We promote all our holiday destinations at the favoured seasonal times which should be subject to favourable conditions. However, these cannot be guaranteed as bad weather or unseasonal effects on fishing seasons/conditions are out of our control. 

Note: Gillhams Holidays UK Ltd can not monitor every destination’s weather daily, plus adverse weather conditions can change very quickly. We advise all customers to check the local destination weather for the time of their travel before departure.

​Please note, for safety reasons the guide’s decision if it is safe to embark due to adverse weather conditions is final. On any days lost or effected because of bad weather or unseasonal effects on fishing seasons/conditions, if Gillhams Holidays UK Ltd receives any refund for any days lost or affected, this will be passed on to the client.

​Gillhams Holidays UK Ltd cannot be held responsible for any inconvenience or cost resulting from bad weather or unseasonal effects on fishing seasons/conditions.

Our Liability

We cannot accept any liability for any delay in your outward or inward flight/s, regardless of the weather, airline rescheduling, industrial action, mechanical failure, medical outbreaks or an act of terrorism causes the cancellation or delay. We will give no refunds or compensation for lost time and services from the itinerary.

 

We accept responsibility for any death, bodily injury or illness caused to you because of the proven negligent acts and/or omissions of our employees and agents.


Except as provided in paragraphs (a) to (c) below, we accept responsibility for any damage caused to you as a result of any failure to perform, or improper performance of the services we have agreed to provide to you.


We will not be responsible where failure or improper performance is not due to our fault because a) Such failure is attributable to you or any member of your party: b) Such failure is attributable to a third party unconnected with the provision of the services to be provided to you and is unforeseeable or unavoidable; or c) Such failure is due to unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised, or to an event which we, even with all due care, could not foresee or forestall.


Such circumstances or events include (without limitation) war or threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, or adverse weather conditions.


Subject to the limitation of liability set out in the following paragraph, our liability to you for any loss and damage which you may suffer (other than personal injury resulting from the non-performance or improper performance of the services included in the holiday is limited to the price of your holiday.


We do not accept liability for any claim (other than claims for personal injury arising from the non-performance or improper performance of any service) in contract, tort (including negligence) or otherwise for consequential, economic, or indirect loss or damage.


Nothing in these booking conditions affects your statutory rights. Please note that where the cause of your loss, damage or injuries is due to our agents, suppliers or sub-contractors, our acceptance of any liability is subject to you assigning to us your rights against them and to your co-operating with us in any legal action we may take against them.
We accept responsibility for the proper performance of the obligations in the contract between you and the company even where these obligations are performed by one of our suppliers. However, we do not accept responsibility for any damage/injury caused that is attributable to your actions, acts of some other party unconnected with the contract services or where the damage/injury results from events/circumstances which are outside our control and could not be reasonably foreseen.


For injury claims, our liability is in all circumstances limited to the price of the trip booked. In agreeing to these terms, you accept this limit on our liability because it helps keep the prices of the trips as low as possible.
